Process Serving
Process serving involves getting legal documents to respective parties. Court documents are hand delivered to the respective parties by a disinterested party (someone who is not involved with the lawsuit). Once the document is served, the process server will provide the client with a a “proof of service” or other document that provides information on how, when and where the document was served. This document is then provided to the court to show that the party was given proper notice of the court action.
Contrary to popular belief, only the presiding judge can determine if service of process was proper. A professional process server will know the rules that pertain to the particular document served. Following the rules will minimize the chances a judge will determine that service of process was not proper.
